Terms of Service
Last updated: 2026-09-301. General Provisions
- These Terms of Service define the rules for using the Foxtales application (hereinafter: "Application" or "Service"), available at https://app.foxtales.cc .
-
The operator of the Application is:
Hubert Górski
, providing the service as a natural person not engaged in business activity.
Correspondence address: Radom, ul. Kościelna 37A/1, Poland.
Email contact: office@foxtales.cc . This address is also the designated contact point for direct communication with Member State authorities, the Commission, and the Digital Services Board in accordance with the Digital Services Act (DSA). - Using the Application constitutes acceptance of these Terms of Service and the conclusion of an agreement for the provision of electronic services between the User and the Operator under the conditions set out in the Terms of Service.
- The Terms of Service are available in the Application and on the website. In case of contradiction between versions published in different places, the version provided at foxtales.cc prevails.
2. Definitions
- Service / Application – Foxtales, the application/service available online.
- User – a person using the Service.
- Account – the User's account in the Service.
- User Content – any materials published by Users (text, image, sound, multimedia, data).
- Codes / Activation Codes – unique character strings entered in the Application to unlock functions or virtual elements.
- Catalog – a collection of questions grouped thematically by the User, which may have its own name and description constituting User Content.
- Public Question – content shared by the User to the Application's public question database, available to all other Users. Such a question is shared through a public catalog or a shared catalog.
- Memory – a system-generated summary of a question and the answers given to it from a given game session in graphic or text form, intended for sharing.
- Custom Avatar – an image (e.g., a photo) uploaded by the User as their avatar in a Catalog in which the Operator has enabled this option. A Custom Avatar is visible only in games played with that Catalog and to the author of the Catalog on the list of people who have saved it.
- Catalog Logo – an image (e.g. a company or brand mark) uploaded by the author of a Catalog for which the Operator has enabled custom branding. The Catalog Logo is shown in games played with that Catalog, on the sign-in screens of people who entered the Application from a link to that Catalog or from an invitation to such a game, and on the Catalog page.
3. Scope of Services and Free-of-Charge Nature
- The Service is of an entertainment and social nature and is provided in a free-to-use model. The Operator does not charge fees for basic use of the Application.
- As of the date of publication of these Terms of Service, the Application does not offer paid features or an internal store. In the event of introducing paid functionalities, the Operator will inform about it separately and update the Terms of Service and payment rules.
- The User does not have to enter into an agreement for paid services to use the basic functions of the Application.
- The option to set a Custom Avatar in selected Catalogs is free of charge. The Operator decides in which Catalogs this option is available, may disable it at any time (disabling it hides Custom Avatars in the given Catalog), may limit the number of uploads per day, and may temporarily suspend uploading new images (images already uploaded remain visible).
- Uploading a Catalog Logo is free of charge. The Operator decides in which Catalogs this option is available and may disable it at any time (disabling hides the Catalog Logo but does not delete it). The same daily upload limit and the same temporary suspensions apply to Catalog Logos as to Custom Avatars.
4. Conclusion and Termination of Agreement
- The agreement for the provision of electronic services between the User and the Operator is concluded upon account registration or when the User begins using the Service (if use is possible without registration).
- The User may terminate the use of the Service at any time. Deleting the Account (termination of the agreement by the User) is done by sending an email to office@foxtales.cc or through the account deletion function, if available in the Application. The Operator will delete the Account and data in accordance with the provisions of the Privacy Policy and applicable laws.
- The Operator may terminate or rescind the agreement (block or delete the Account) in the event of a breach of the Terms of Service by the User, of which the User will be informed at the specified email address or using other available contact channels, unless there are justified grounds for immediate blocking (e.g., violation of law, security).
- The effective date of termination or change of permissions is included in the notification sent to the User; in the case of significant changes to the Terms of Service, the Operator will inform Users at least 7 days before the changes take effect (vacatio legis), unless laws require a longer period.
- Persons who have reached the age of 13 may use the Service. Use of the Application by persons under 16 years of age should take place with the knowledge and consent of a parent or legal guardian.
- The Application enables the use of a so-called Temporary Account (guest access). The agreement for the provision of services in the case of a Temporary Account is automatically terminated approximately 24 hours after its creation, which results in the deletion of personal data associated with it, while maintaining anonymized User Content, in accordance with the provisions of section 6 of the Terms of Service.
5. Registration and Account Security
- Registration requires providing a valid email address, username, and password. The User is obliged to provide truthful data.
- The User is responsible for maintaining the confidentiality of login data and not sharing it with third parties.
- The selected username is public by default for other participants in a game session and visible in generated Memories. The User has the option to enable "Anonymous Mode" in the settings, which replaces their username on generated Memory graphics with a generic term (e.g., "Player") or hides it completely.
- The User is obliged to immediately report to the Operator any suspicion of unauthorized access to the Account to the address office@foxtales.cc .
- The User may not take actions aimed at bypassing the Application's security, brute-forcing codes, or other attempts to violate the system's integrity; such actions constitute a breach of the Terms of Service and the law.
6. User Content – License and Publication Conditions
- The User retains copyright to their User Content.
-
By entering User Content into the Application (regardless of whether it is shared publicly
or remains private), the User grants the Operator a free, non-exclusive, and irrevocable
license to:
- display, share, and store User Content as part of the provision of the Service to all its recipients (also after the account has been deleted by the author of the content),
- technical modifications necessary to display the content (e.g., transcoding, resizing),
- creating backups and storing in the Operator's systems and in the systems of service processors (backups),
- sharing with other Users within the Application's features (in the case of content marked as public by the User),
- using the entered content (including questions, catalogs, and answers that have been made public) for the purpose of Service development, expansion of the global question database, statistical analysis, and further sharing in the Application, including after its permanent anonymization as a result of Account expiration or deletion.
- By participating in a game session, the User agrees to have their answers paired with their username within Memories generated by other participants of the same session.
- By saving another User's Catalog to their library, the User agrees to have their username and avatar shown to the author of that Catalog and acknowledges that the author may revoke their access to the Catalog. Enabling "Anonymous Mode" also hides the username and the Custom Avatar on that list.
- By sharing a Public Question, the User grants the Operator and other Users a free license to use this question within their own games inside the Application.
- The license granted by the User is valid for an indefinite period and is irrevocable. After the Account is deleted (both permanent and after automatic expiration of a Temporary Account), all User Content (including private and public Catalogs and Questions) is not deleted from the database but is permanently anonymized by removing the link to the Account's personal data. This content remains in the Application's resources and may be further used by the Operator in accordance with the granted license.
- The provisions on the irrevocability of the license and on the retention of User Content after the Account is deleted do not apply to Custom Avatars. With respect to a Custom Avatar, the User grants the Operator a free, non-exclusive license to store it, process it technically (cropping, resizing, removing metadata), and display it as part of the Service — solely for the period during which it is stored. A Custom Avatar is not used for Service development or shared outside the Application. The User may delete it or replace it with another one at any time — in the game lobby or in the Account settings (the “My photos” section) — subject to Section 10 (an avatar hidden as a result of moderation). A Custom Avatar is deleted together with the Account or the Catalog, within the time limits specified in the Privacy Policy.
- By uploading a Custom Avatar, the User declares that they hold the rights to the image and, if the image depicts a person other than the User, that this person has consented to the dissemination of their likeness in the Application. Uploading an image depicting the User constitutes their consent to the dissemination of their likeness to the extent described in the definition of Custom Avatar; the User may withdraw this consent by deleting the Custom Avatar. A User under 16 years of age may upload a Custom Avatar depicting their likeness only with the consent of a parent or legal guardian.
- The User declares that they have all rights to the materials entered and that their publication does not violate the rights of third parties. The User undertakes to release the Operator from third-party claims resulting from copyright or personal rights infringements.
- By making a Catalog public, the User represents and warrants that its name, description, and included questions comply with the Terms of Service, contain no spam or prohibited content specified in Section 7, and do not violate copyrights, trademarks, or personal rights of third parties. The Operator reserves the right to remove a Catalog from public view, including in cases of low quality, illegibility, repetition, or reports of violations.
- The provisions of this section concerning Custom Avatars, including those on the licence and on deletion, apply accordingly to Catalog Logos, except that technical processing of a logo consists of downscaling and removing metadata, without cropping, and the author of the Catalog deletes or replaces the Catalog Logo when editing the Catalog. By uploading a Catalog Logo, the author declares that they hold the rights to the mark it contains (including a trademark) or the right holder’s consent to its use in the Application. A Catalog Logo may not use another party’s mark without the right holder’s consent, suggest an affiliation with the Operator or with an entity the author of the Catalog does not represent, or contain personal data or the likeness of a person who has not consented to its dissemination; the prohibitions of section 7 also apply. The Catalog Logo is deleted together with the author’s Account or with the Catalog.
7. Prohibited Content and Restrictions
It is strictly forbidden to publish User Content that:
- violates applicable law (including incitement to crime),
- violates copyright, related rights, or personal rights of third parties,
- contains child pornography, content of a pedophilic nature, or sexualizing persons under 18 years of age (including fictional characters depicted as minors),
- contains erotic or pornographic content in a manner inconsistent with separate regulations or the Application's rules (if a given feature is marked as 18+),
- constitutes deepfake porn, materials violating the intimacy or privacy of others,
- shares personal data, account numbers, passwords, or other sensitive information of third parties,
- contains content inciting hatred, violence, threats, terrorist content, or materials promoting extremism,
- constitutes spam, unsolicited advertisements, or mass commercial information without the Operator's consent,
- contains materials from illegal scraping, automatic content downloading, or other sources violating copyright,
- contains gore or other extremely shocking materials in a manner inconsistent with the law or good practices,
- introduces any personal data (own or third-party) in the text content created within the Application (e.g., in questions, answers, catalog names). The entered texts are subject to automated translation and processing by external algorithms. A likeness in a Custom Avatar is permitted on the terms set out in Section 6,
- as a Custom Avatar: depicts the likeness of another person without their consent, serves to impersonate another person (including the Operator or public figures), or contains — apart from the likeness itself — personal data or information allowing a person's identity or whereabouts to be determined (e.g., documents, license plates, an address, a phone number, a QR code).
8. 18+ Content and Obligations for Adult-Oriented Content
- If a given part of the Application contains content intended exclusively for adults (18+), such sections will be clearly marked and accompanied by an adult content warning. The User should confirm they are of legal age before accessing such sections.
- The Operator does not perform mandatory age verification in every case; responsibility for using 18+ content rests with the User and their guardians (in the case of minors). The Operator may, but is not obliged to, implement age verification mechanisms.
- It is prohibited to publish any content sexualizing and depicting persons under 18. In the event of finding such content, the Operator will take immediate action (removal of content, reporting to the relevant authorities), provided the obligation to report results from law.
9. Activation Codes and Prohibition of Bypassing Security
- The Application enables entering Activation Codes that unlock features or game elements.
- The Operator does not sell Codes within the Application; Codes may be distributed outside the Application (prizes, promotions, partners).
- The Operator is not responsible for transactions regarding Codes made outside the Application (sale, exchange between users, etc.).
- Any attempts to bypass security mechanisms related to Codes are prohibited, including brute-forcing, mass guessing attempts, manipulating code validation mechanisms, or other actions aimed at unauthorized content unlocking. Such actions may result in Account blocking and reporting to the relevant authorities.
10. Moderation, Responsibility, and Lack of Preventive Monitoring
- The Operator does not continuously monitor all published content in a preventive manner. However, the Operator may at any time review, remove, or restrict access to content if there is a suspicion of violation of the Terms of Service or the law.
- The Operator is not responsible for User Content published in the Application — responsibility for its legality and content rests with the publishing User.
- The Operator provides the possibility of reporting illegal content or content violating the Terms of Service. Upon receiving a credible report, the Operator will take immediate action to remove or block access to such content. In the event of a decision to remove content or block an Account, the Operator will provide the User with the justification for this decision.
- An automated community moderation mechanism operates in the Application. Content that collects a certain number of reports from different Users is automatically and temporarily hidden to prevent further violations until it is verified.
- The Operator reserves the right to remove content without giving a reason if it violates the Service's security rules or the provisions of point 7 of the Terms of Service.
- When an attempt is made to share User Content outside the User's private resources (e.g. making a folder public, starting a public game, or sharing a Memory), such content is subject to automated scanning by artificial intelligence algorithms for safety and compliance with these Terms of Service.
- As a result of the scan, the system assigns the content an appropriate verification status (among others: approved, flagged for review, rejected).
- If, as a result of the automated scan, content is unambiguously rejected , the User may not share the associated folder, start a public game, or make public a Memory containing that content.
- If content is flagged for review by the AI, the system conditionally allows the folder to be shared, the game to be started, or the Memory to be published. Such content nevertheless remains subject to subsequent verification by the Administrator.
- The Administrator has full authority to manually verify content and change its status via the administrative panel. If the Administrator decides to assign a rejected status to content that was previously made public (e.g. under a conditional flag or mistakenly approved by the AI), that content immediately disappears from public resources and is no longer visible to other Users.
- Custom Avatars are automatically checked on every upload, before publication, by an external image analysis service (Google Cloud Vision) for adult, violent, and racy content. An image assessed as prohibited is not published. An image with an ambiguous assessment, as well as an image that could not be checked automatically (e.g., because the service was unavailable), is published and is subject to subsequent verification by the Administrator.
- A Custom Avatar may be reported in the Application by Users who are playing together with its author in the same room (the “Report photo” option). Any other person — including the person shown in the image — may report a Custom Avatar by writing to office@foxtales.cc (Section 11). An avatar hidden following reports or by decision of the Administrator is no longer displayed. If the author's Account has an e-mail address, the author receives a message stating the reasons: which Catalog and which image the decision concerns, whether it was made automatically (following reports) or by the Administrator, and until when an appeal can be lodged. The User may appeal against this decision within 14 days by writing to office@foxtales.cc (Section 11); when considering the appeal, the Administrator may suspend the permanent deletion until a decision is made. During this time, the User may not delete the hidden avatar or replace it with a new one; after 14 days have elapsed since the last moderation decision, the avatar is permanently deleted and cannot be restored. The exception is an image whose securing is requested by a court or public prosecutor — it is stored on the terms described in the Privacy Policy. An avatar restored after review by the Administrator is not hidden again automatically on the basis of reports. Blocking an Account hides all of its Custom Avatars; they are permanently deleted after 14 days, and unblocking the Account does not restore them. Hidden Custom Avatars, like other hidden User Content, are taken into account when deciding whether to block an Account.
- Catalog Logos are subject to the same moderation as Custom Avatars, on the terms described in the previous paragraph: an automatic check on every upload, reports, hiding, a statement of reasons for the author, appeal, permanent deletion 14 days after the last moderation decision, preservation at the request of a court or prosecutor, and hiding when the Account is blocked. A Catalog Logo may be reported in the Application by signed-in Users to whom it is shown (the “Report logo” flag icon on the Catalog page), and by anyone else at office@foxtales.cc (section 11). The author cannot delete a hidden Catalog Logo or replace it with a new one.
11. Notice-and-Takedown Procedure and Counter-Notices
- Reports of copyright infringement or other significant violations can be sent to the address: office@foxtales.cc . The report should include: reporter's data, description of the work, location of the material in the Application, a statement of good faith, and a statement of truthfulness (in accordance with applicable laws), as well as contact details.
- After receiving a complete report, the Operator may take temporary measures (hiding, blocking, removal) until the matter is clarified.
- A User whose content has been hidden after community reports or removed is informed about it and may file an appeal (counter-notice) containing: contact details, indication of the content, justification, and a statement of truthfulness. The Operator considers the appeal through manual verification and makes a final decision on restoring or permanently removing the content.
- In case of abuse of the reporting procedure (false statements), the Operator reserves the right to take appropriate actions against the reporter, including disclosure of data at the request of law enforcement agencies, in accordance with applicable regulations.
- The Operator is not obliged to disclose User data to the reporter; disclosure may occur only on the basis of a legally binding request from authorities or in cases provided for by law.
12. Cache, Backups, Logs
- Content and data sent in the Application may be stored in cache, backups, and system logs. Deletion of content by the User does not mean the immediate removal of all copies (e.g., backups, cache, logs), which may be stored for the period specified in the Privacy Policy.
- Server logs and technical information (e.g., IP address, header data) may be stored in accordance with safety rules and the Operator's legal obligations; storage periods and security measures are described in the Privacy Policy.
13. Security
- The Operator uses technical and organizational measures appropriate to the nature of the Service in order to protect data and the system (transmission encryption, updates, server protection). However, the Operator does not guarantee the total absence of risk — use of the Service is at the User's risk.
- The User undertakes not to send malicious software, viruses, attack automation scripts, or other harmful data to the Application.
14. Automation / AI-Generated Content
- The Application utilizes artificial intelligence (AI) tools and automated translation systems (e.g., Microsoft Ireland Operations Limited, Google Ireland Limited) to generate, translate, and analyze User Content (questions, answers, catalogs), as well as to analyze images uploaded as Custom Avatars.
- The Application's architecture strictly separates the User's identification data (e.g., email address, username) from the User Content. Only the content itself — texts and Custom Avatar images stripped of metadata — is sent to external AI providers, without the email address, username, or any other identifiers that would allow the author to be identified.
- Due to the use of external AI tools, which may use the entered texts to improve their language models, the User is strictly prohibited from placing any personal data in the text content entered into the Application (in accordance with Section 7 of the Terms of Service). The User bears full legal responsibility for any violations consisting in the voluntary entry of personal data in the Application's text fields.
- The Operator is not responsible for the final form and meaning of automatically generated or translated content. Responsibility for publishing and potential law violations rests with the User who approved or published the generated content.
- Due to their contribution to the global database of the Service and the fact that content generated exclusively by AI tools does not constitute personal data, catalogs and questions generated by artificial intelligence are not permanently deleted from the Application's systems. The use of the "Delete" function by the User in relation to such content results in its immediate removal from the User's profile view (i.e. hiding) and the cessation of its further publication under their account, however, the Operator retains the right to keep them in its database in accordance with the granted license.
15. Limitation of Liability
- The Operator is not liable for indirect damages or lost profits resulting from the use of the Service, unless laws provide otherwise.
- The Operator does not guarantee continuous availability of the Service or absence of errors; the Operator may carry out maintenance work and updates.
- The Operator is not responsible for Users' actions outside the Service (including trading Codes outside the Application).
- The Operator provides the function of generating Memories, but is not responsible for their further distribution by Users outside the Application (e.g., on social media). The User sharing a Memory does so at their own responsibility, taking into account the privacy of other players participating in the session.
- Every participant in a game session has the right to request the removal of a Memory in which they participated if they believe it violates their privacy or good name. The request for removal should be sent to office@foxtales.cc , providing information allowing for identification of the content. The Operator will remove the indicated Memory from the Application's systems immediately, no later than within 14 days from receiving the report. The Operator can only remove the Memory from the Application's technical resources. The Operator does not have the technical capability to remove content that has already been downloaded or shared by Users on external sites (e.g., social media).
16. Complaints and Handling of Reports
- Complaints regarding the operation of the Service should be directed to the address office@foxtales.cc with a description of the problem and contact details.
- The Operator will make efforts to respond to the complaint within 30 calendar days. In justified cases, the period for consideration may be extended, of which the User will be notified.
- In the event of disputes, the User has the right to file a complaint with the President of the Office for Personal Data Protection (UODO) or seek claims through court proceedings.
17. Consumer Rights and Information on Free-of-Charge Nature
- The Service is provided free of charge. There are no fees for basic use of the Application (as of the date of the last update of the Terms of Service).
- If paid features are introduced in the future, Users will be informed about it in advance, and the Terms of Service will be updated in the manner described in point 4.
- Information on consumer rights, including available remedies, is available from the relevant authorities and in applicable regulations. In the case of purchasing digital products outside the Application (e.g., codes sold in an external store), the return conditions and consumer rights regarding such purchase are regulated by consumer regulations and the seller's store regulations.
18. Changes to the Terms of Service
- The Operator may change the Terms of Service. The Operator will inform Users of significant changes at least 7 days before the date the changes take effect by sending a notification to the email address or by updating the date in the document header.
- Changes to the Terms of Service take effect after the period indicated in the change information (vacatio legis), unless the notification indicates another period consistent with the law.
- Continuing to use the Service after the changes take effect constitutes acceptance of the new conditions. If the User does not agree with the changes, they may terminate the use of the Service in accordance with point 4.
19. Termination of Service Provision and Data Storage
- The Operator reserves the right to temporarily suspend or completely terminate the provision of the Service, with notification to Users with appropriate advance notice, unless laws provide otherwise.
- In the event of permanent termination of the Service provision, the Operator will inform Users of the date of cessation of the Service provision and of the manner of handling User data (copies, export, deletion) in accordance with the Privacy Policy and applicable laws.
20. Final Provisions, Applicable Law, and Jurisdiction
- In matters not regulated by these Terms of Service, the provisions of Polish law shall apply.
- In the event of disputes arising from the use of the Service, if the User is a consumer, the competent court will be the common court competent for the consumer's place of residence or the court competent in accordance with the provisions of law. If the User is not a consumer, the court competent for the Operator's registered office shall have local jurisdiction.
- The prevailing language of the Terms of Service is Polish.
- Trademarks and Proper Names: Any proper names, titles of works (e.g., movies, games, books), character names, and trademarks used in the names or content of Catalogs created by Users belong to their respective owners. They are used exclusively for informational, descriptive, and fan/entertainment purposes. Their use in the Application does not imply or suggest any affiliation, sponsorship, endorsement, or official partnership between the Operator and the rights holders.
These Terms of Service are for information and organizing purposes for the rules of using the Foxtales Application. The document does not replace legal provisions. In case of doubt, please contact: office@foxtales.cc .
